The Puerto Rico Architectural Heritage Archive (PRAHA) is not responsible for any rights regarding the digital records shown through its platform or the content therein. Hence, the PRAHA does not have any part in the expedition of permits for the use of the images in the digital repository. In addition, the PRAHA takes no part in decisions regarding individual restrictions, due to specific legislation or agreements, over the images it holds. The PRAHA is responsible, however, for informing its users that the materials shown may be protected or have restrictions due to copyright, donor agreements, privacy rights, publicity rights, licensing or trademarks.
The born digital records that reside in the PRAHA or those produced for the purpose of providing access are shared for research, visualization, and identification purposes. These are considered “works for hire” for all legal purposes under the 1976 federal Copyright Act. Therefore, any information, petition, assistance, or determination regarding the images about their creation, reproduction, exhibition, or use in a project under development or one to be developed in the future, corresponds to each of PRAHA’s collaborating repositories or to the institutions they are affiliated with.
The digital records, images, and other resources within the collections which were originally the product of the work of government officials or contractors of the Government of Puerto Rico or the United States are in the public domain. However, several resources included in the PRAHA may be subject to restrictions of use or reproduction under the Copyright Act or due to individual donor agreements. Anyone interested in using these digital resources must determine the current status of the intellectual property rights of any and all records or images they may intend to publish or use in a project while exceeding Fair Use.
The Copyright Act allows for the reproduction and use of portions of the material under certain conditions specified within the law. These include some instances where reproduction is permitted by libraries and archives. One of these conditions is that reproductions be solely used for non-commercial purposes such as academic, teaching, study, research, the production of knowledge, and others. Publishing or reproducing some of the records with a commercial aim or intention of monetization could be grounds for a lawsuit for infractions to the Copyright Act. It is important to underscore that the Copyright Act also protects unpublished works from the moment of their creation as well as any of their versions.
The resources should be appropriately cited. The PRAHA prefers this citation model for the materials residing in PRAHA which are to be published or shared, social media included.
The institutions that collaborate in the PRAHA reserve their right to facilitate or deny copies of the records in their custody if, in their informed opinion ‒following professional best practices and in the observation of the ethical standards of archival science‒, the reproduction process could be harmful to the physical medium or support or if it might be in violation of the law.
To request reproductions of permissions for the use of any of the images in the PRAHA, please contact the repositories directly. The metadata that accompanies the images shows the name of the repository in custody of the physical record.

In addition, all the content produced for the PRAHA ‒such as guides, exhibitions, descriptions, and other graphic elements, not including the digital images that conform the collections‒, is shared under a Creative Commons license.
As a user of the PRAHA, you agree to use our site legally, not to use our site for illegal purposes and not to violate the intellectual property rights of the Site owners or any third party to the Site. If we believe you are using our site illegally or in a manner that violates these Terms of Use, we reserve the right to limit, suspend or terminate your access to our site. We also reserve the right to take any legal steps necessary to prevent you from accessing our site.
Fundación Luis Muñoz Marin and our directors, officers, agents, employees, contractors, subsidiaries and affiliates will not be liable for any actions, claims losses, damages, liabilities and expenses including legal fees from your use of the PRAHA.
Except where prohibited by law, by using the PRAHA you indemnify and hold harmless Fundación Luis Muñoz Marín and our directors, officers, agents, employees, contractors, subsidiaries and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our site of our violation of these Terms of Use.
If at any time any of these provisions set forth in these Terms of Use are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms of Use. All other provisions will not be affected by the removal and the rest of these Terms of Use will still be considered valid.
These Terms of Use may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our site and the way we expect users to behave on our site. We will notify users of changes to these Terms of Use by posting a notice on our site.
